These Terms of Use (“Terms”) govern your access to and use of the TAMO-HAUS website, platform, and services. By creating an account, accepting these Terms electronically, or subscribing to any package or service, you confirm that you have read these Terms and agree to them in full on behalf of the business you represent. If you do not agree, do not use the Services.
These Terms should be read together with our Payment & Subscription Policy and our Privacy Policy, which form part of them. Together they are the contract between you and us.

2. Who We Are
The Services are provided by Tamo Haus Advertising & Marketing Company W.L.L. (شركة تامو هاوس للدعاية والتسويق ذ.م.م), trading as TAMO-HAUS, a limited liability company registered in the State of Kuwait under commercial registration no. 538574 and commercial licence no. 2025/21660. Our registered address is Sheikh Ali Abdulaziz Salem Al-Sabah Building, Al-Shuhada Street, Block 5, Sharq, Kuwait City, State of Kuwait.
You can contact us by email at contact@tamohaus.com, by WhatsApp on +965 99566983, or through our website at www.tamohaus.com.
3. Business Clients Only & Eligibility
The Services are offered only to businesses, such as companies, shops, and sole traders acting for the purposes of their trade or business. They are not offered to consumers acting for personal, family, or household purposes. By accepting these Terms, you confirm that you are using the Services for business purposes.
Your statutory rights: these Terms do not limit any right you have under Kuwaiti law, including Consumer Protection Law No. 39 of 2014, which also protects legal persons that contract for services. If any provision of these Terms or of the Payment & Subscription Policy conflicts with a mandatory legal right, the legal right prevails and the provision applies only to the extent the law allows.
The person who registers and accepts these Terms must be at least 18 years old and authorised to bind the business they represent. If you accept on behalf of a business, the business is bound by these Terms, and you confirm that you have that authority.
4. Account Registration & Approval
To use the Client Dashboard you must sign up, confirm your email address, and complete onboarding, in which you provide your brand name and business activity (industry) and choose a Package offered for your industry or request a custom package.
Every new account is reviewed by our team. We may approve, request further information about, delay, or decline an account at our reasonable discretion. After approval, the Client Dashboard stays locked until the invoice for your subscription is paid, unless our team chooses to unlock it earlier.
You are responsible for the accuracy of the information you provide and for keeping it up to date, for keeping your login credentials confidential, and for all activity under your account. Tell us without delay at contact@tamohaus.com if you suspect unauthorised use of your account.
5. The Services & the Platform
We provide the Services with reasonable skill and care and in a professional manner. The scope of what we deliver is set by your Package, by any accepted Marketplace order or quote, and by any other written confirmation from us. Anything not listed there, including any additional social platform, is an additional service.
Through the Client Dashboard you can, depending on your Package: view your Package and subscription; review the content calendar (posts, stories, and reels) and approve content or request revisions; follow tasks; view advertising campaigns and analytics; view and download invoices; order additional services in the Marketplace; manage your business profile, account settings, and Connected Accounts; and deactivate or delete your account.
The Platform evolves continually. We may add, change, suspend, or discontinue any feature of the Platform at any time. We will not use such a change to reduce the deliverables of a Package you have already paid for. General descriptions of the Services on our website are not a contractual commitment to specific functionality.
Working hours: our team answers enquiries and revision requests during working hours, Sunday to Thursday from 5:00 p.m. to 10:00 p.m. Kuwait time. Approved content may still be scheduled and published outside these hours.
6. Electronic Contract, Communications & Language
When you tick the acceptance box or click to accept these Terms, the Payment & Subscription Policy, and the Privacy Policy, you enter into a binding electronic contract with us. Your electronic acceptance has the same legal effect as signing a paper contract by hand. Under Kuwait’s Electronic Transactions Law No. 20 of 2014, electronic records, electronic signatures and acceptance, and electronic communications have legal effect and may be used as evidence, and you agree not to dispute the validity or enforceability of this contract solely because it was concluded electronically.
We record each acceptance, including the document version, its SHA-256 fingerprint, the date and time, and the IP address and browser information used, as evidence of what was accepted. After each acceptance, we send you by email a copy of the exact text you accepted.
You agree that we may send notices, invoices, and other communications to the email address registered on your account, through the Client Dashboard, by WhatsApp, or by post to your registered address, and that such communications satisfy any requirement for written notice. A message sent from or to the official WhatsApp numbers of the two parties is accepted as written documentation.
These Terms are published in Arabic and English. In case of any difference between the two versions, the Arabic version prevails.
7. Fees & Payment
Subscriptions, invoices, payment methods, late payment, commitment discounts, content edit fees, Marketplace orders, refunds, and cancellation are governed by the Payment & Subscription Policy. All fees are in Kuwaiti Dinar (KWD) and are final: the price stated in your quote, contract, Package, or invoice is the full amount you pay, with no hidden charges and no extra fee for paying electronically. No tax currently applies to our fees; if a tax or government charge is introduced by law, we will tell you before it is added.
Fees paid are not refundable except as expressly stated in the Payment & Subscription Policy or as required by Kuwaiti law.
8. Advertising Budgets
Advertising budgets are not included in our fees. You pay them directly to the advertising platforms (such as Meta, TikTok, or Snapchat) through your own advertising account and payment method. We do not collect, hold, or pay advertising budgets on your behalf unless we agree otherwise in writing.
Charges, taxes, currency conversion, billing errors, and payment failures on your advertising account are between you and the platform. Your Package may set a minimum advertising budget for each campaign so that targeting can work effectively. If your advertising account has no funds or no valid payment method, the related campaigns stop, and this is not a failure on our part.
9. Your Cooperation: Materials, Approvals, Access & Timelines
Timely delivery of the Services depends on your cooperation. You agree to:
- provide the materials and information we reasonably request (such as brand identity, images, product information, and prices) within 3 business days of our request;
- review content submitted for your approval and approve it or request revisions within 3 business days of its submission;
- give us the access needed for the Services, such as admin, manager, or partner access to your social-media and advertising accounts, and keep your Connected Accounts active and correctly connected;
- tell us without delay about any change that affects the Services, such as a change of management, activity, offer, price, brand guidelines, or accounts.
If you are late in supplying materials, approving content, or responding to us, or if a Connected Account is disconnected or restricted, the related timelines are extended accordingly, and such delay is not a failure on our part. Content that is not approved is never published, whatever the delay. If an item submitted for your approval receives no response within 3 business days, it counts as delivered for that cycle, and we are not required to make it up in a later cycle. Our remedy for deliverables we fail to deliver for reasons attributable to us is set out in the Payment & Subscription Policy.
Our employees: during our relationship and for 12 months after it ends, you agree not to hire or engage directly, without our prior written permission, any of our employees who worked on your account, to obtain from them outside our engagement the same services they provided to you through us. You remain free to deal with any other company, supplier, or service provider.
10. Content Approval & Your Responsibility for Published Content
No publication without your approval: we do not publish any content (text, image, video, story, reel, or advertising campaign) to your Connected Accounts before you have given your explicit approval through an official channel: the Client Dashboard, email, WhatsApp, or in person at a meeting with our team, which our team records with its date.
Responsibility passes on approval: by approving content, you confirm that you have reviewed it in full, that it is accurate and lawful, and that you authorise its publication. From the moment of approval, full responsibility for the content and its publication passes to you, including any claim, complaint, penalty, or fine that may result from it.
Our role: our role is creative and technical only: we design, write, produce, and publish according to your instructions and approvals. We do not provide legal advice, we do not carry out a legal review of content, and we do not verify the accuracy of your commercial claims, prices, offers, or product information. You are the party responsible for reviewing every item of content before it is published.
Who is the advertiser: for the purposes of the advertising and consumer-protection laws, you are the advertiser and the supplier of the products and services we promote for you. We act as your service provider: we produce the content and, where you authorise it, publish it on your accounts on your instructions.
Arabic text and ad disclosure: every advertisement we prepare for you includes Arabic text, as Consumer Protection Law No. 39 of 2014 requires, and other languages may appear beside it. Content that promotes your products or services through influencers, talents, or paid partnerships is clearly marked as advertising (for example, «إعلان»), and you agree not to remove that marking.
Record of approvals: when you approve content in the Client Dashboard, we keep a record of the approval with its date and time and the IP address and browser information used, as evidence of your approval. When you approve by email, WhatsApp, or in person, our team records the channel and the date of your approval.
Accuracy of your information: you confirm that all the information, claims, prices, and offers you give us are accurate and lawful, and you alone are responsible for any error or misleading claim in them.
Unlawful content: if approved content includes any violation, such as a false or misleading claim, an infringement of the rights of others, a breach of consumer-protection laws, or content contrary to public morals, you bear full responsibility for it as the party that approved it. If any authority or third party takes action against us because of content you approved, section 23 applies.
Video and reels: before filming, you approve the script and storyboard in writing. Dissatisfaction with a result that was produced according to the approved script is not a reason for a free re-shoot. A re-shoot or major change requested after that approval is charged at the price we quote you before the work starts.
Client-requested revisions are subject to the monthly allowance and fees set out in the Payment & Subscription Policy. Revisions we initiate ourselves are not charged.
11. Licences, Permits & Legal Compliance
You confirm that your business holds, and will keep valid and complete for the whole term, all the commercial licences, permits, and approvals required for its activity and for selling and marketing its products and services in the State of Kuwait, issued by the competent authorities (for example, the Ministry of Commerce and Industry, Kuwait Municipality, the Ministry of Information, the Ministry of Health, or any other relevant authority). You are solely responsible for ensuring that your business, products, and services, and every claim, price, offer, discount, competition, and promotion that you ask us to market or that you approve:
- comply with the laws and regulations of the State of Kuwait and of any other country where they are promoted, including laws on advertising, media, consumer protection, commerce, electronic commerce, and intellectual property;
- have every permit or approval required before publication (for example, the Ministry of Commerce and Industry licence for any temporary discount or special offer under article 13 of Consumer Protection Law No. 39 of 2014, licences for contests, draws, gifts, and prizes, any advertising licence required by the Ministry of Information under the Media Regulation Law issued by Decree-Law No. 102 of 2026 once it applies, or approvals for regulated products such as food, medicines, cosmetics, or health products);
- comply with the policies and advertising rules of each platform on which they are published.
We are not liable for violations: we bear no legal or administrative liability for any violation, penalty, fine, closure, or claim that arises because your business operates without a licence or permit, because your products, services, or promotions do not comply with the law, or because of content you approved. Any damage, claim, or fine that results is borne by you alone, without any recourse against us. We may ask you for the number or a copy of any licence or permit before we publish related content, and we may postpone publication until we receive it.
Our right to refuse: we may refuse to produce or publish, or pause or remove, any content or campaign that we reasonably believe is unlawful, misleading, infringing, contrary to public morals or platform policies, or harmful to our reputation, without this being a breach of our obligations.
12. Practices That Harm Your Accounts
We follow professional ethics and the rules of the digital platforms, and we do not use or recommend any practice that breaks platform policies or endangers the safety of your accounts. You agree not to use, on the accounts we manage, any of the following prohibited practices: buying followers, likes, or views; using bots or fake engagement; publishing misleading advertisements; running advertisements in ways that break platform rules; dealing with banned accounts; or ignoring our written warnings.
If you use any of these practices, we are not liable for the consequences, including: a ban, restriction, or suspension of the account by the platform; loss of access to the account, its content, or its followers; a drop in engagement when platforms remove fake followers; penalties or fines from the platforms; and damage to the reputation of the account or brand. We may also terminate the Services immediately and keep the fees paid for the current cycle.
13. Connected Accounts, Account Ownership & Handover
You may connect accounts on Meta (Facebook Pages and Instagram professional accounts), TikTok, and Snapchat through each platform’s official authorisation process. You authorise us to use each Connected Account only to the extent needed to provide the Services to you, as described in our Privacy Policy, including publishing content you have approved and reading performance and advertising data. You may disconnect a Connected Account at any time from the Client Dashboard or from the platform’s own settings; doing so may prevent us from delivering some of the Services.
You own your accounts: your pages, social-media accounts, advertising accounts, business portfolios (such as Meta Business Suite), followers, and audiences remain your property, including any that we set up for you. We act on them only as an authorised admin, manager, or partner.
Handover at the end: within 7 days after the Services end for any reason, we remove our access to your accounts or transfer to you the ownership of any account or asset we set up for you, and we make your final, paid Deliverables available for download. Returning your accounts is never conditional on payment, but the transfer of Deliverables is subject to section 15.
14. Third-Party Platforms
The Services rely on third-party platforms, including social networks, advertising networks, payment providers, and banks. We are not affiliated with these platforms and do not control them. We are not responsible for their policies, availability, outages, changes to their algorithms, features, or interfaces, the rejection of content or advertisements, or any action they take against your accounts, such as restriction, suspension, or removal. Your use of each platform is also subject to that platform’s own terms.
15. Your Content & Deliverables
Your content: you keep ownership of your Client Content, brands, and trademarks. You grant us a non-exclusive, royalty-free licence, for the duration of our relationship and as long as needed afterwards to complete our obligations, to use, store, copy, adapt, and publish Client Content as needed to provide the Services. You confirm that you hold all rights and consents needed in the Client Content you provide, including the consent of any person who appears in it, and that its use by us as instructed by you does not infringe any third-party right or any law. On request, we provide a consent form that people who appear in content can sign.
Deliverables: once you have paid in full all fees due for the cycle or order to which a Deliverable relates, ownership of that final, delivered Deliverable passes to you for use in your business. Until full payment, it remains our property. Drafts, concepts, and options that you did not select remain ours.
The following remain our property and are not transferred: our tools, templates, software, methods, know-how, and any material that existed before the Services, as well as the Platform. Third-party assets, such as licensed images, fonts, or music, remain subject to their owners’ licences. Where a Deliverable features models, influencers, or other talent, your right to use it is limited to the scope, channels, and period agreed for that talent.
Source files: we keep the original source files of the Deliverables for 12 months after the Services end, even if your account has been deleted. You may ask us for a copy during that period; after it, we may delete them.
16. Portfolio, Case Studies & Results
Portfolio: by accepting these Terms, you agree that we may display the final Deliverables we produced for you, together with your brand name and logo, in our portfolio on our website and our official channels, including after the Services end. If you ask us in writing at contact@tamohaus.com, we will remove a specific work from our portfolio, or hide any sensitive information in it, within a reasonable time.
Results and figures: we use your results or figures, such as follower growth, sales, or return on advertising spend, in our marketing materials or case studies only with your prior written approval, because they belong to your business and some of them come from your Connected Accounts.
17. Our Intellectual Property
The Platform, the Client Dashboard, and our software, designs, interfaces, workflows, methods, algorithms, data structures, and underlying technology belong exclusively to us or our licensors and contain our trade secrets and proprietary information. These Terms do not transfer any ownership in them to you. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Client Dashboard for the internal purposes of your business while your account is active.
18. Confidentiality
Each party may receive non-public information from the other, such as business information, strategies, figures, customer data, and passwords. Each party agrees to keep the other’s confidential information confidential, to use it only for the purposes of the Services, and to disclose it only to its staff, contractors, and service providers who need it for those purposes and are bound by confidentiality obligations, or where required by law, a court, or a competent authority.
Our confidential information includes the features, functionality, design, and workflows of the Client Dashboard, our internal pricing, and our methods of working. You agree not to disclose such information to any third party or competitor.
Your confidential information includes your non-public business information, such as sales figures, plans, unpublished content, advertising-account data, and the data we obtain from your Connected Accounts. We keep it confidential and do not use it for any other client.
These obligations do not apply to information that is or becomes public without breach of these Terms, that the receiving party already lawfully held, or that it developed independently, or to the display of Deliverables in our portfolio under section 16. Confidential information stays confidential, without any time limit, during our relationship and after it ends.
19. Restrictions & Acceptable Use
You agree that you will not:
- reverse engineer, decompile, disassemble, or attempt to extract the source code, logic, or structure of the Platform;
- copy, reproduce, imitate, or create a derivative of the Platform or any of its features or design;
- access the Platform by automated means, or scrape, frame, index, or monitor it without our authorisation;
- share your login credentials or give access to the Client Dashboard to any unauthorised person;
- use the Platform for competitive benchmarking or to develop a competing product or service;
- circumvent any access or security control, or interfere with the integrity or performance of the Platform;
- upload malicious code, or content that is unlawful, defamatory, obscene, or that infringes the rights of others;
- use the Services for any unlawful, fraudulent, or misleading purpose.
20. Service Standards, Availability & No Guarantee of Results
We aim to keep the Platform reliably available, but we do not warrant that it will be uninterrupted or error-free. We may carry out maintenance or updates that temporarily affect access. Except as expressly stated in these Terms and the Payment & Subscription Policy, the Platform is provided “as is” and “as available”.
Marketing performance depends on many factors outside our control, including platform algorithms and decisions, market conditions, competition, the quality of your products, your prices, and your advertising budget. We commit to delivering the agreed deliverables with professional care, but we do not guarantee any particular figure or result, such as reach, engagement, follower growth, leads, sales, or return on advertising spend. Any forecasts or estimates we share are for guidance only.
If we fail to deliver the agreed deliverables of a paid cycle for reasons attributable to us, you are entitled to the remedy set out in the Payment & Subscription Policy.
21. Privacy & Data
We process personal data, including data from your Connected Accounts, in accordance with our Privacy Policy. Instructions for deleting your data are available at /legal/data-deletion. You confirm that any personal data of third parties that you provide to us has been collected lawfully and may be shared with us for the purposes of the Services.
22. Limitation of Liability
To the maximum extent permitted by Kuwaiti law:
- we are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profit, revenue, opportunity, data, goodwill, or reputation;
- we are not liable for any loss arising from content you approved, from information or materials you provided, from your lack of any licence or permit, from the practices described in section 12, or from the acts or decisions of third-party platforms;
- our total aggregate liability arising out of or in connection with the Services or these Terms will not exceed the fees you actually paid to us for the last paid billing cycle before the event giving rise to the liability, or, for a claim about a Marketplace order, the amount you paid for that order.
Nothing in these Terms limits liability for fraud, wilful misconduct, or gross negligence, or any other liability that cannot be limited under Kuwaiti law.
23. Indemnification
You agree to indemnify us and to defend us against, and protect us from, any claims, losses, liabilities, penalties, fines, and expenses (including reasonable legal fees) arising out of your Client Content, content you approved, your products, services, or promotions, your lack of any licence or permit, your breach of these Terms, or your violation of any law or third-party right.
24. Suspension & Termination
By you: you may cancel your subscription at any time in line with the Payment & Subscription Policy, and you may deactivate or delete your account from the Client Dashboard settings.
By us: we may suspend the Services, or terminate them and your access to the Platform, in the following cases:
- non-payment of an invoice, as set out in the Payment & Subscription Policy (suspension after a 3-day grace period, and termination after 30 days);
- a material breach of these Terms that you do not remedy within 7 days of our written notice; termination may be immediate, without notice, where the breach is serious, repeated, or cannot be remedied, including a serious or repeated failure to cooperate (section 9), a prohibited practice (section 12), a breach of confidentiality, or misuse of our contractual relationship;
- the existence of a legal, security, or reputational risk for us, our clients, or third parties arising from your use of the Services, or a requirement by law or a competent authority to stop the Services.
On termination, your licence to use the Client Dashboard ends, the fees for work already performed are earned and are not refunded, and any amounts already due remain payable, together with any amount due under the Payment & Subscription Policy. You should download any Deliverables and invoices you need before your account is deleted. Provisions that by their nature should continue after termination continue to apply, including those on fees owed, intellectual property, confidentiality, account handover, limitation of liability, and indemnification.
25. Force Majeure
Force majeure means an external event that could not be foreseen or prevented and that makes performance of an obligation actually impossible, limited to: major natural disasters, wars, epidemics subject to a government decision, official government decisions that close the activity, and widespread outages of essential services (such as electricity, communications, the internet, or a platform as a whole).
The following are not force majeure: forgetfulness or being busy, individual financial difficulties, a change of mind, foreseeable events (such as holidays, Ramadan, and seasons), individual technical faults, and internal disputes.
A party that relies on force majeure must notify the other party in writing within 7 days, with supporting evidence, and the event must actually prevent performance and not merely make it inconvenient. The effect of force majeure is only to suspend the affected obligations while it lasts; it does not suspend payment obligations already due and does not create a right to a refund of payments.
26. Changes to These Terms
We may update these Terms from time to time. Every version, material or not, receives a new version number and is permanently archived with its publication date and SHA-256 fingerprint at /legal/history. Previous versions are never altered.
Material changes: we will notify existing clients by email and in the Client Dashboard at least 30 days before a material change takes effect. New clients are bound by the new version from its publication date. If you do not accept a material change, you may cancel your subscription before the change takes effect, without any cancellation fee and without having to pay back any commitment discount, as set out in the Payment & Subscription Policy; the previous version continues to apply to you until your subscription ends. If you continue to use the Services after the effective date, you will be asked to accept the new version, and until you accept it or cancel, you may not be able to use the Client Dashboard.
Non-material changes: changes such as correcting typing errors, updating contact details, or clarifications that do not reduce your rights may be published without prior notice, but they still receive a new version number and an archive entry.
27. Complaints, Governing Law & General
Complaints: if you have a complaint or dispute, please contact us first at contact@tamohaus.com or by WhatsApp on +965 99566983, with the details of your complaint. We will acknowledge it and respond in substance within 7 business days, and both parties will try in good faith to resolve it amicably. If it is not resolved within 30 days of your complaint, either party may refer the dispute to the courts. This does not affect your right to file a complaint with the Ministry of Commerce and Industry or any other competent authority under Kuwaiti law.
Governing law: these Terms and any dispute arising from or in connection with them are governed by the laws of the State of Kuwait, and the courts of the State of Kuwait have exclusive jurisdiction, without prejudice to the jurisdiction of any committee or authority competent under Kuwaiti law.
General: if any provision of these Terms is found unenforceable, the remaining provisions stay in effect. A failure or delay in exercising a right is not a waiver of it. You may not assign these Terms without our written consent; we may assign them to a legal successor of our business. We may use any feedback or suggestions you give us without restriction or compensation. These Terms, together with the Payment & Subscription Policy, the Privacy Policy, and any accepted quote or written agreement for specific services, form the entire agreement between you and us regarding the Platform and the Services. If a signed written agreement with you conflicts with these Terms, the signed agreement prevails for the matters it covers. However, no agreement can reduce the protections of the Privacy Policy or allow any use of personal data, or of data from Connected Accounts, beyond what the Privacy Policy and the rules of the relevant platforms permit.
For any question about these Terms, contact us at contact@tamohaus.com.
